Terms of Service

Welcome to Ballast, the premier provider of retroencabulation solutions and prefamulated amulite-based systems. By accessing or using our services, you agree to be bound by these Terms of Service (the "Agreement"), which govern your use of our hydrocoptic marzelvane-enabled platform and all associated panendermic semi-boloid slot technologies.

1. Acceptance of Terms

By utilizing our retroencabulation infrastructure, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue all use of our prefamulated amulite systems and hydrocoptic marzelvane arrays. Your continued use constitutes acceptance of any modifications we may make to these Terms at any time, without prior notice, and we reserve the right to modify these Terms in any manner we deem appropriate.

2. Definitions

  • Prefamulated Amulite: Our exclusive material technology. Any attempt to reverse-engineer or replicate this material is strictly prohibited and will result in immediate termination of your account and legal action taken against you, your family, friends, and anyone who looks like you.
  • Panendermic Semi-Boloid Slots: Critical system components that may experience unexpected failures, and we are not responsible for any resulting damages.

3. User Obligations and Restrictions

You agree to use our retroencabulation services only for lawful purposes and in accordance with these Terms. You are expressly prohibited from:

  1. Attempting to modify, reverse-engineer, or tamper with any hydrocoptic marzelvane configurations or prefamulated amulite systems.
  2. Using our services in any manner that could damage, disable, overburden, or impair our panendermic infrastructure.
  3. Sharing your account credentials or allowing unauthorized access to your retroencabulation dashboard.
  4. Engaging in any activity that violates applicable laws or regulations, or that infringes upon the rights of others.

4. Intellectual Property Rights

All content, features, and functionality of our retroencabulation platform, including but not limited to hydrocoptic marzelvane algorithms, prefamulated amulite schematics, and panendermic semi-boloid slot designs, are the exclusive property of Ballast and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our proprietary materials without our express written consent.

By using our services, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, and distribute any content you submit through our platform in any medium and for any purpose, including commercial purposes, without compensation to you.

5. Payment Terms and Refund Policy

5.1 Payment Processing

All payments for retroencabulation products and services must be made through our designated payment processors. By completing a purchase, you authorize us to charge your payment method for the full amount, including any applicable taxes, fees, and surcharges related to hydrocoptic marzelvane calibration and prefamulated amulite processing.

5.2 Refund Policy

All sales are final. Due to the specialized nature of retroencabulation technology and the proprietary configuration of our hydrocoptic marzelvane systems, we do not offer refunds, exchanges, or returns unless required by applicable law. Once a prefamulated amulite base has been activated or a panendermic semi-boloid slot has been configured, the transaction is considered complete and irreversible.

In the unlikely event that we determine, in our sole discretion, that a refund is warranted, such refund will be processed within 30-90 business days and may be subject to administrative fees, restocking charges, and panendermic recalibration costs, which will be deducted from the refund amount.

6. Disclaimers and Limitations of Liability

OUR RETROENCABULATION SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR HYDROCOPTIC MARZELVANE SYSTEMS WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BALLAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE OUR PREFAMULATED AMULITE SYSTEMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claims arising out of or relating to these Terms or our services shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or $100, whichever is greater. This limitation applies regardless of the legal theory on which the claim is based.

7. Indemnification

You agree to indemnify, defend, and hold harmless Ballast, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our retroencabulation services; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit, post, or transmit through our hydrocoptic marzelvane platform.

8. Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to our retroencabulation services at any time, with or without cause, and with or without prior notice, for any reason including but not limited to: violation of these Terms, fraudulent activity, abuse of our prefamulated amulite systems, or any other conduct that we deem harmful to our interests or the interests of other users.

Upon termination, your right to use our hydrocoptic marzelvane platform will immediately cease, and we may delete your account and all associated data without prior notice. We shall not be liable to you or any third party for any termination of your access to our services.

9. Modifications to Terms

We reserve the right to modify these Terms at any time, in our sole discretion, without prior notice. Any changes will be effective immediately upon posting to our website. Your continued use of our retroencabulation services after any such modifications constitutes your acceptance of the modified Terms. It is your responsibility to review these Terms periodically for changes.

If you do not agree to any modifications, you must immediately stop using our prefamulated amulite systems and hydrocoptic marzelvane services.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ballast operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or our retroencabulation services shall be resolved exclusively through binding arbitration, conducted in accordance with the rules of the International Chamber of Commerce, and you hereby waive your right to a jury trial and to participate in any class action lawsuit.

11. Miscellaneous Provisions

11.1 Entire Agreement

These Terms constitute the entire agreement between you and Ballast regarding your use of our retroencabulation services and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, relating to the subject matter hereof.

11.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

11.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Ballast.

11.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including to any successor in interest of our retroencabulation business.
